Spiro Moss has decades of experience in the field of labor and employment law.  As one example, founding partner Dennis Moss was the sole attorney for the plaintiff employee in a leading California Supreme Court case on wage and hour laws, Ramirez v. Yosemite Water Co.,  20 Cal.4th 785 (1999).  Ramirez was a precursor to hundreds of successful class action suits in California (some by Spiro Moss) that significantly advanced the overtime rights of California employees by reducing the frequency of improper classifications of "exempt" status.

Currently, Spiro Moss focuses much of its employer liability practice on wage & hour class action and representative claims, including claims for:

  • Failure to pay minimum wage
  • Failure to correctly calculate overtime wages
  • Failure to comply with meal period requirements
  • Failure to comply with rest break requirements
  • Failure to provide accurate itemized wage statements
  • Failure to timely pay final wages upon termination of employment
  • Failure to reimburse employee expenses
  • Failure to pay out accrued but unused vacation time upon termination of employment
  • Violation of the Labor Code Private Attorneys General Act of 2004 (Labor Code § 2698, et seq., "PAGA")
  • Violation of the Fair Labor Standards Act (29 U.S.C. § 201, et seq.)
  • Related violation of the Unfair Competition Law (Business and Professions Code § 17200, et seq.)

Currently, Spiro Moss has several cases pending before the California Supreme Court that will clarify various aspects of California's wage & hour laws.
